Questions

Car accident claims, answered.

How long do I have to file a car accident claim in Texas?

Texas generally allows two years from the date of the crash to file a lawsuit. The clock starts on the day of the collision, not when treatment ends. Claims involving minors, government entities or delayed discovery can follow different timelines, so it pays to act early, while evidence and memories are fresh.

What if the other driver doesn't have insurance?

Uninsured or underinsured motorist coverage may apply. We review the policies involved and look for other responsible parties, such as an employer when the driver was on the job.

What if I was partly at fault?

Texas uses modified comparative fault. A recovery is reduced by each driver's share of fault, and a driver found more than 50 percent responsible can't recover from the others. Insurers often try to shift blame, which is why building the liability case matters.

Should I talk to the other driver's insurance company?

Be careful. Adjusters may sound friendly, but their job is to save the insurance company money, and early offers are often far below what a claim is worth. Talk to an attorney before giving a recorded statement or accepting an offer.
